Perlindungan Hukum Melalui Diversi Bagi Anak Yang Melakukan Tindak Pidana

Crimes committed by children are getting more and more prevalent so that it is disturbing the community. Children who commit crimes are processed through a special court and regulated in the Child Criminal Justice System Law (UU SPPA). The SPPA Law in this case adheres to the concept of restorative justice which is realized through diversion efforts. The purpose of this paper is to find out and examine the relationship between diversion and restorative justice and also to know and examine legal protection efforts through diversion for children who commit crimes. The legal research method in this journal applies normative legal research, with a law approach and legal concept analysis. The results show that restorative justice as meant in the SPPA Law is the obligation to carry out diversion and legal protection efforts through diversion for children who commit criminal acts can be in the form of refunding losses in the event of a victim, medical and psychosocial rehabilitation, handover to parents/guardians, participation in education or training in educational institutions or LPKS for a maximum of 3 (three) months, or community services for a maximum of 3 (three) months.
